YouTube, this is my ANGRY face when I think of you right now!!!

YouTube removed my Black Veil Goth party video. Not for copyright reasons (I had permission to film and all the footage belonged to me). No, Herr YouTuben decrees: “Your video has been disabled for violating Community Guidelines.”

The Tube Nazi doesn’t tell users WHY they supposedly violated their “Community Guidelines.” Nor does it let users respond. Nope, YouTube simply removes your video and slaps you with a penalty, and that’s that. “Additional violations may result in the temporary disabling of your ability to post content to YouTube and/or the termination of your account.”

My guess is that Herr YouTuben removed my Black Veil video… because it has 20 seconds of a fetish performance at the very end.

I’ve uploaded the “offending” video above and here on MetaCafe. Watch the fetish clips at the end and decide for yourself. The submissive girl is not naked: she’s wearing underwear, and the lighting is very dark so you can hardly see anything. Yes, she is being flagellated, but the context is quite clear: this is a consensual stage performance by adults at a Gothic party.

This is not porn, gratuitous violence or shock material. This is more of a dark arts performance than anything sexual.

And I think if you watch the entire video, my intent is quite clear: I’m reporting on what goes on at Osaka’s Black Veil event. Most of the video is about DJ Taiki’s set, Kozi’s appearance, and The Dark Marchen’s avantgarde stage show. It wouldn’t be honest coverage to leave out the fetish clips — because this is a part of Gothic/Industrial subculture; this is what goes on at almost every Tokyo and Osaka Goth party. I don’t think it was right for YouTube to flag my channel, and leave other videos of animal and human cruelty standing.

YouTube has been engaging in other Nazi-like behavior lately. For instance, artist David Choi got his channel shut down for performing covers… hello, what about free use?

I’m not happy with YouTube. But they’re the leading video host, and a major connecting ground.

And so, I’ve posted the original video here on Metacafe. I put an edited version back on my YouTube channel (also above) with a RANT about their actions (so that my subscribers know what’s up). Let’s see if they take my free speech down, eh?

UPDATE: This is getting more ridiculous by the minute. Metacafe pulled my video as well. But DJ Taiki uploaded a video of Black Veil that shows naked boobs, fetish whipping… and YouTube hasn’t taken it down. Yet…

    Honestly I’ve seen much worse survive on YouTube without getting flagged, that sucks! (But it looks like her breasts are bared?)

    And unfortunately, covers aren’t a fair use in most countries, I learned that the hard way. There’s two layers of copyright: on the performance of the music by the original artist, and also on the music itself (when performed by anyone).

I did not see anything wrong done here. Sad to see you had to alter a video that cover an event in Tokyo that happens all the time. What will they do next?

    such a cool video. that dj rocks! i looove the fetish scene! s&m between consenting adults is fabulous, in my humble opinion. i don’t know much about YouTube or if they have any videos online similar to yours. i know nothing about their policies, but i think they should have communicated clearly their reasoning to you. some of the submissive girl’s goodies appear to be hangin’ out (can’t really tell because the lighting is quite dark), and she’s being flaggelated. i’m torn, because although i love this, i can’t really blame the old fogeys for wanting to protect the under 12′s.

I guess the problem is finding the right host. As for whether they’re hipocritical, I guess they are… but as you found there’s always alternatives.

I suspect they have a bunch of immature dildos and dildettes who capriciously take down videos when it suits their current mood. I just had a run-in with Raw Story where their so-called moderators were running wild like a bunch of 2-year-olds with too much sugar. Fortunately, the owner reads his e-mail and disciplined the little knuckleheads. Trouble with Google is you really can’t get through to the honchos.

    Actually now that I think of it…this is so typical of the new YouTube…the new damn totalitarian fascist YouTube.

    I mean have you guys noticed that there has been just a shit ton of ads before like every video, music is always being censored because of “copyright” reasons, YouTube always trying to follow the 1st suspect it sees – which means if you do something wrong right at the beginning…they’ll constantly THINK you’re doing the wrong thing over and over again…and then the whole “type in the image to post more comments”, and then “YOU MUST HAVE A GOOGLE ACCOUNT to use YouTube” – and although I have a Google account and use tools like GMail, Maps, Earth, Reader, Wave and Picasa – it makes no sense to have deleted all the other people’s regular YouTube account and then force them into having a Google account.

    Just because Google bought YouTube for $1.65 billion…it does not mean that they’d have to go through a complete takeover of the site and CONVERT everybody to the Google ways…- but that’s just good business – FOR THEM.

    Fuckers…

    Anyway glad to see the video on Metacafe…I really loved the music Taiki san put on – sounds great. Still hope you had the best of fun…and forget about the YouTube thing…it’s just getting ridiculous with them.

    Just stick to the other video sites such as DailyMotion, Vimeo, Metacafe, or Veoh. Hope it helps!

    I think it’s missing the point a little to call YouTube’s activity (whether fair or unfair) anti-free speech and so on. YouTube is a business, and definitely shouldn’t be thought of as an unalienable right. They’re going to choose what content to have in order to make them profit. YouTube has strayed away from the alternative, indie video scene (which started as their original concept) for years now and their commercial behaviors are, at least to me, really predictable at this point. I think people should consider giving more attention to the less-mainstream services if they really want a networking place. If we really want to continue to have our voice and art heard on the net we need to empower ourselves by avoiding the mainstream outlets. What do you think?

      That’s part of my dilemma. YouTube is THE leader when it comes to video hosting. Whenever you, me and friends look up a song or post one on Facebook, we go to YouTube. Just as we go to Google for search.

      I don’t have a problem with putting my fun videos on a different hosting site. But my “reporting” videos have the goal of getting the word out on Japan’s subculture and arts: such as Osaka’s Goth scene at Black Veil. This is a culture that very few people would be able to see for themselves, and I want to support the scene by having the information to reach as large an audience as possible. (and I have close to 3000 subscribers on YouTube.)

      So it’s a struggle… perhaps a balance of using non-mainstream outlets that embrace darker material, and the mainstream ones but with caveats…

    There really isn’t anything wrong with your video. I like it and it’s perfectly fine, it’s clearly a report on a stage show. I think it’s just business, you don’t actually pay Youtube to show your video, but Lady Gaga does. And I think her new video is ridiculous. Ridiculously ridiculous.

    I've only just seen your post, and I hate to point out the fact that when I try to view the Metacafe vid, it says “This video has been removed from Metacafe”… So unless you have deleted it yourself, it means that whatever's wrong with the YouTube policies is wrong with the Metacafe regulations as well… :(
